Compensation Fund/COIDA Registration and letter of good standing
1. What is the Compensation Fund and when must a business register for it?
The Compensation Fund also known as WCA or COIDA (Compensation for Occupational Injuries and Diseases Act) is a government institution put in place to protect employees and employers should an injury/disease/death occur to any employee "in the line of duty".
According to labour law as soon as a business employ a worker (can only be one), the business must register with the Compensation Fund.
2. Does the business or the employees register with the Compensation Fund?
The business is registered with the Compensation Fund. The Compensation Fund registration number is registered in the business name and will stand until de-registered.
3. What are the consequences for my business if I am not registered with the Compensation Fund?
Apart from breaking the law the business can face huge fines or even prosecution for not complying with the Act . The business can be held responsible for huge amounts of money due to claims relating to injury on duty, diseases or death from an employee.
4. I am a sole proprietor, should I still register?
Yes, as soon as you employ one worker you must register with the Compensation Fund.
5. What happens after my business has been registered with the Compensation Fund?
A Return of Earnings (W.as.8) form must be submitted to the Fund before 31 March annually. Based on the amount of earnings (salaries) paid to employees and members, and category the business falls under an assessment will be raised and become payable.
6. What do I do if I am registered and an injury/death on duty occurs?
A claim then needs to be raised with the Compensation Fund who will investigate the circumstances. Subject to certain circumstances the Compensation Fund will then be responsible for any costs.
7. Can I get a letter of good standing once registered?
Once the provisional assement/oustanding returns has been paid/submitted a letter of good standing will be issued.
1. How does it work?
Step 1 - simply complete the online form below and submit.
Step 2 - pay our service fee via credit card/EFT or bank deposit. This fee is for our service. After you have been registered you will also be assessed by Compensation Fund, This amount will be come payable upon registration.
Step 3 - send documents through as requested below.
Step 4 - We will send you a proof of submission to Compensation Fund within 5 -10 working days (stamped 1st page of the application form) and a letter on our letterhead stating that registration is in process.
- Once submitted the registration is in the hands of the Compensation Fund. On average they take 21-30 working days to process, it can take longer.
- Once registered a provisional assessment will be raised by the Compensation Fund. This will be payable to Compensation Fund once registration is complete
2. What documents are needed?
Please fax/e-mail us the following documents after completing the online form below.
- In case of a CC/Company the incorporation certificate of the business (CK1/CK2/CM1+CM29/COR 14.3)
- In case of a CC/Company certified copies of the ID's of all of the members/directors.
- In case of a sole proprietor a certified copy of the ID of the owner of the business.
- POA document will be e-mailed to you , to be completed, signed and returned.
Once registered and provisional fees have been paid/outstanding ROE's submitted where applicable a letter of good standing can be obtained
